Limitation of liability

We shall not be held liable for any claims, regardless of the legal basis, arising from delays or non-performance, breaches of informational or supplementary obligations, violations of preliminary agreements, failure to fulfill contractual duties, infringement of third-party intellectual property rights, or torts. Exceptions apply only if we have acted willfully, with gross negligence, or in cases of slight negligence involving essential contractual obligations. 

Liability also applies if damages arise from the absence of a specifically guaranteed characteristic. We shall not be liable for any foreseeable damages arising from the aforementioned circumstances. Consequential damages, such as loss of profits, are excluded. 

However, this limitation does not apply to damages caused by gross negligence or intentional misconduct by Nurse Scrubs Kenya’ legal representatives or executive officers. Additionally, any liability under product liability laws and for personal injury or death remains unaffected.

Supplier code of conduct

Our suppliers must ensure that all workers are treated equally, without discrimination, based on gender, race, religion, age, disability, sexual orientation, or nationality. They must also implement measures to protect migrant workers and provide them with appropriate support services.

Suppliers must keep their workers safe and healthy. They must follow all safety laws and rules and ensure the safety of their workplaces. If workers live in company housing, it must also be safe and healthy.

Employers must take proactive steps to minimize their workplace and operations’ environmental and community impacts. This involves incorporating sustainability into business operations by reducing environmental impact, conserving resources, and promoting eco-friendly practices.
